Step 1 evidence checklist

Officers first ask whether you meet at least 3 of the 10 regulatory criteria (or a major one-time award). Each item below is what they look for in the file, and what typically fails.

1. C1 · Awards for excellence

8 C.F.R. § 204.5(h)(3)(i). Prove you received it, it is national/international, and it is for excellence — not participation.

2. C2 · Membership in selective associations

8 C.F.R. § 204.5(h)(3)(ii). Outstanding achievement must be a condition of admission, judged by recognized experts.

3. C3 · Published material about you

8 C.F.R. § 204.5(h)(3)(iii). The piece must be about you, in professional or major media — not your employer’s blog.

4. C4 · Judging the work of others

8 C.F.R. § 204.5(h)(3)(iv). You were asked to judge others in the field — not to review your own team’s work.

5. C5 · Original contributions of major significance

8 C.F.R. § 204.5(h)(3)(v). Originality plus major significance, independently corroborated. Letters alone usually fail.

6. C6 · Scholarly articles

8 C.F.R. § 204.5(h)(3)(vi). Articles in professional or major trade publications. Venue quality matters; citation volume is mostly Step 2.

7. C7 · Artistic exhibitions or showcases

8 C.F.R. § 204.5(h)(3)(vii). Display of your work at artistic exhibitions. Other fields usually mark N/A.

8. C8 · Leading or critical role

8 C.F.R. § 204.5(h)(3)(viii). Two tests: your role was leading/critical, and the organization is distinguished.

9. C9 · High salary or remuneration

8 C.F.R. § 204.5(h)(3)(ix). High relative to others in the field — independent benchmarks, not coworkers.

10. C10 · Commercial success (performing arts)

8 C.F.R. § 204.5(h)(3)(x). Box office, sales, or equivalent. Other fields should mark N/A or use comparable evidence.

What is the EB-1A visa?+
EB-1A is a U.S. immigrant category for people of extraordinary ability in the sciences, arts, education, business, or athletics. You can self-petition. There is no job-offer or labor-certification requirement.
Can I apply for EB-1A from another country?+
Yes. Nationality is not a bar. You can live outside the United States and still put a file together. Wait times after approval depend on the visa bulletin, which this tool does not score.
Does this follow the Kazarian two-step?+
Yes. Step 1 asks whether at least three of the ten criteria (or a major award) are supported. Step 2 looks at the whole record: sustained acclaim, and whether you sit among a small group at the top of the field. Meeting three boxes is not the same as a grant.
Can I upload evidence?+
Yes. Paste a resume or drop in PDFs and letters. We read the text, match it to the ten criteria, and flag patterns officers often reject, such as internal awards or letters with no backup.
Will this write my petition story?+
It drafts a framing outline from the strongest parts of your file. Treat it as a starting note for you and counsel, not a letter you file.
Can I file what it produces?+
No. The report and draft are labeled as drafts. A licensed immigration attorney should review anything before it goes to USCIS.
Is this legal advice?+
No. This is a study and planning tool. USCIS decides each case on its own record. Talk to a qualified immigration lawyer about yours.
Does a company award count as a major award?+
No. A one-time major award means a prize of the Nobel, Oscar, Olympic, Fields, or Turing class. Employee-of-the-year, internal, and most field prizes are “lesser” awards and still need 3 of the 10 criteria.
What if a criterion does not apply to my field?+
USCIS allows comparable evidence when a criterion does not readily apply — for example, artistic exhibitions or performing-arts commercial success for a software engineer. Comparable proof has to equal the same kind of showing, not a weaker stand-in. We mark those boxes N/A and point you to the criteria that do apply.
What does the free evaluation include?+

How is this different from EB-2 NIW?+
EB-1A asks whether you sit at the top of your field with sustained acclaim. NIW asks whether your work is in the national interest. They are different tests. A strong NIW file is not automatically an EB-1A file.
